1. Introduction

Welcome to SoftingArt. These Terms and Conditions ("Terms") govern your use of our website and the services provided by SoftingArt ("we", "our", or "us"), located at SoftingArt, Sanjay Colony, Sector 6, Gurugram, Haryana 122001.

By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

2. Services

SoftingArt provides IT software development services including but not limited to:

• Custom software development
• Web application development
• Mobile application development (iOS & Android)
• Cloud solutions and DevOps services
• AI/ML and data analytics solutions
• UI/UX design services
• Website maintenance and support

The specific scope, deliverables, and timeline for each project will be outlined in a separate project proposal or agreement.

3. Payments

• All payments are processed securely through Razorpay payment gateway.
• Project costs, payment milestones, and schedules will be agreed upon before the commencement of work.
• Payments are due as per the agreed schedule. Late payments may result in project delays or suspension of services.
• All prices are quoted in Indian Rupees (INR) unless otherwise specified.
• Applicable taxes (GST) will be charged as per Indian tax regulations.

4. Project Engagement

• A project begins only after the signed agreement and receipt of the initial payment/advance as agreed.
• The client is responsible for providing timely feedback, approvals, and any required content or assets to avoid project delays.
• Any changes to the agreed scope of work may result in revised timelines and additional charges, which will be communicated and agreed upon in advance.

5. Intellectual Property

• Upon full payment, the client will own the intellectual property rights to the custom deliverables created specifically for the project.
• SoftingArt retains the right to use general tools, frameworks, libraries, and reusable code components that are not unique to the client's project.
• We reserve the right to showcase the completed project in our portfolio unless a non-disclosure agreement (NDA) is in place.

6. Confidentiality

Both parties agree to keep all project-related information, business strategies, and proprietary data confidential. This obligation survives the termination of the engagement.

7. Warranties and Disclaimers

• We strive to deliver high-quality, bug-free software. However, we do not guarantee that the deliverables will be entirely free of defects.
• A warranty/support period (as agreed in the project proposal) will be provided after delivery, during which we will fix reported bugs at no additional cost.
• Our website and services are provided "as is" without warranties of any kind, express or implied.

8. Limitation of Liability

SoftingArt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services. Our total liability shall not exceed the total amount paid by the client for the specific project in question.

9. Termination

• Either party may terminate the engagement by providing written notice as per the terms of the project agreement.
• In case of termination, the client will be billed for work completed up to the date of termination.
• Any advance payments for undelivered work will be refunded as per our Refund Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
